NY Times's Joe Sharkey Sued in Brazil for Role in Boeing Crash PDF Print E-mail

Joe Sharkey Rosane Gutjhar, the widow of one of the victims of flight 1907's accident, a collision over the Amazon between a Boeing 737 and a Legacy executive jet piloted by two Americans, which took place on September 29, 2006, filed suit against American journalist, Joseph M. Sharkey.

Gutjhar, who filed her suit, in October, is seeking damages for pain and suffering, according to the Association of Relatives and Friends of Gol's Flight 1907 Victims.

This week, Judge Dr. Humberto G. Brito, of Curitiba's 18th Civil Office, released the letter rogatory against the journalist. The letter is with a sworn translator and later it will go to the Justice Department and Itamaraty (Foreign Relations) for its issuance to the United States.

According to the lawsuit, Sharkey, a passenger in the Legacy jet that crashed with Gol Linhas Aéreas' Boeing 737-800, with great influence in the media, began a campaign in his blog in favor of the jet's pilots with the objective to move his countrymen in order to prevent the pilots' return to Brazil.

According to Rosane Gutjhar, he began offending Brazilians indiscriminately, which prompted the widow to file suit seeking relief for pain and suffering.

In the petition filed by the widow's lawyers, Oscar Fleischfresser and Carla Fleischfresser, in the 18th lower civil court in Curitiba, there is a suggestion to take as a parameter for non-financial damages awarded, similar values to those that would apply to the journalist in his own country.

"This would be a way to halt, effectively, his illegal and damaging behavior, in detriment of the widow and all other Brazilian citizens. The other request is to have a judicial instruction for him to apologize to all the Brazilian citizens, through the same media used by him," concludes Oscar.

Sharkey's a journalist, and no court in the US would ever entertain tossing out the 1st amendment because "feelings were hurt". Here maybe a different story, especially involving someone from the imperialistic north, but good luck collecting. Regardless, I was at his blog daily after the accident, he reported things as they unfolded from a very unique position. Nothing more nothing less. And yes, the way things unfold in Brazil, for most North Americans, is nothing short of BIZARRE. And he wrote so. There was nothing offending. Except maybe the death threats he was receiving from Brazilians.

I'm sorry for the loss of all on that flight, as I am with the TAM flight at Congonhas.

This is simply a knee-jerk reaction by lawyers knowing that the inquiry days ago exonerated the legacy pilots and now they can't be sued for damages. Lawyers are desperately grasping at straws watching dreams of a big fat American settlement slip away. One last kick at the can. If anything, the two American pilots would have a better case suing the Brazilian media for slander and libel. I recall quite vividly the cover of IstoE days after the crash. Talk about assigning guilt before a trial.

When i pass out all my dont go to brasil pamplets in spain and other places where they have the tourist
shows my people have been confronted by brasilians demanding them to stop .
even to the point of calling the police and filing a court case for damages to the country
of brasil.
and even called the US embassy to have me stop ,
they were told freedom of speach is a right that had and they could not stop it .

UNLIKE THE PRESS IN BRASIL NOT ABLE TO PRINT ABOUT THE KIDNAPT BOY FROM THE US

looks like land here is cheep and several people i have met said they looked at brasil
but did not buy as realstate people in brasil could not be trustid and have hurd of people buying land ,
houses , apartments , business .
only to have to pay to make people leave the land ,other familey members coming up and demanding
there property back or to be paied offyet again , and we know the brazilian courts are set up to screw the gringoes .
so middle amercia is there best bet , and even Columbia is doing well.
but like brasil chaves land sucks for investment .

It is a pity, isn't ? So may good things could be done in Brazil the right way with both foreign and domestic investments, generating job opportunities for our professionals coming out of the universities and technical schools.Unfortunately, the populism has taken complete command over the logical Brazilians.

The Indians seem to be in favor of handing the pirates over to the U.N. Too gentlemanly, in spite of Bombay being attacked , IMHO. I wonder why their Navy has taken a tougher stance against the pirates.
