NY Times's Joe Sharkey Sued in Brazil for Role in Boeing Crash PDF Print E-mail
Written by Newsroom
Friday, 12 December 2008

Joe Sharkey Rosane Gutjhar, the widow of one of the victims of flight 1907's accident, a collision over the Amazon between a Boeing 737 and a Legacy executive jet piloted by two Americans, which took place on September 29, 2006, filed suit against American journalist, Joseph M. Sharkey.

Gutjhar, who filed her suit, in October, is seeking damages for pain and suffering, according to the Association of Relatives and Friends of Gol's Flight 1907 Victims.

This week, Judge Dr. Humberto G. Brito, of Curitiba's 18th Civil Office, released the letter rogatory against the journalist. The letter is with a sworn translator and later it will go to the Justice Department and Itamaraty (Foreign Relations) for its issuance to the United States.

According to the lawsuit, Sharkey, a passenger in the Legacy jet that crashed with Gol Linhas Aéreas' Boeing 737-800, with great influence in the media, began a campaign in his blog in favor of the jet's pilots with the objective to move his countrymen in order to prevent the pilots' return to Brazil.

According to Rosane Gutjhar, he began offending Brazilians indiscriminately, which prompted the widow to file suit seeking relief for pain and suffering.

In the petition filed by the widow's lawyers, Oscar Fleischfresser and Carla Fleischfresser, in the 18th lower civil court in Curitiba, there is a suggestion to take as a parameter for non-financial damages awarded, similar values to those that would apply to the journalist in his own country.

"This would be a way to halt, effectively, his illegal and damaging behavior, in detriment of the widow and all other Brazilian citizens. The other request is to have a judicial instruction for him to apologize to all the Brazilian citizens, through the same media used by him," concludes Oscar.

Suing McDs for burning yourself with their hot coffee makes more sense than this.

he began offending Brazilians indiscriminately

Sharkey's a journalist, and no court in the US would ever entertain tossing out the 1st amendment because "feelings were hurt". Here maybe a different story, especially involving someone from the imperialistic north, but good luck collecting. Regardless, I was at his blog daily after the accident, he reported things as they unfolded from a very unique position. Nothing more nothing less. And yes, the way things unfold in Brazil, for most North Americans, is nothing short of BIZARRE. And he wrote so. There was nothing offending. Except maybe the death threats he was receiving from Brazilians.

I'm sorry for the loss of all on that flight, as I am with the TAM flight at Congonhas.

This is simply a knee-jerk reaction by lawyers knowing that the inquiry days ago exonerated the legacy pilots and now they can't be sued for damages. Lawyers are desperately grasping at straws watching dreams of a big fat American settlement slip away. One last kick at the can. If anything, the two American pilots would have a better case suing the Brazilian media for slander and libel. I recall quite vividly the cover of IstoE days after the crash. Talk about assigning guilt before a trial.

him to apologize to all the Brazilian citizens

On a lighter note, the coke I was drinking sprayed out of my nose when I came across that line.

In my view the same libel lawsuit should be done in Brazil from USA citizens ...... against LULAand his gang thousands of public statements !!!!! Inclusing for the plane crash statements made by many brazilians officials...such as your ex Defense Minister wearing pampers !

Brazilians are always pro free speech...but only WHEN THEY CAN....open their filthy mouth !
Similar to the WTO negotiations......more trade is logical...only if it is ONE WAY TRADE...the Brazilian way...of course !

Right ?

And then of course I am the one wrong and racist when I said many times that Brazilians are....

CHEATERS, LIARS AND HIDERS !!!!!

And I am of course racist when I said many times

NEVER EVER TRUST AA BRAZILIAN !!!!!

Disagreing with me is fine....but only if one can prove me clearly WHY with facts, not with words ONLY !!!!!!

FACTS ARE a brazilian will always try to rip you off ! Its is their nature, their lifestyle, it is in their genes.
What they cant afford, they will take it....one way or the other ! If they sell you something and then can it back, they are full of pride of how smart they were ! And they are sure this is the only HEALTHY way to do business !!!!!!

Proven time and again....time and again...time and again !

Who are the racists ? The bona fide buyers or the brazilians cheaters, liars and scammers ??????
Even worse Brazilians Courts of INjustice give reason to the scammers !!!!
Sad reality ! Just read what others say...in Forrest comments.

I challenge all idiots and junkies to prove me wrong....if you can !
Then also treat Forrest as racist against Brazilians.
Then also treat Panameans of racists against Brazilians.

And you could as well treat ALL South Americans people of racists against Brazilians. Facts are that no many like you very much.
Why so....in your view ?

But dont worry for our farm in Brazil ! It goes well and is very well protected from scammers and from many local corrupted politicians WHO REGULARLY TRY TO GET THEIR "SHARE OF DUES"

WE ARE UNTOUCHABLE !

LAUGH....LAUGH...LAUGH....LAUGH....LAUGH !!!!!

It is a pity, isn't ? So may good things could be done in Brazil the right way with both foreign and domestic investments, generating job opportunities for our professionals coming out of the universities and technical schools.Unfortunately, the populism has taken complete command over the logical Brazilians.

BTW, I was surprised to know that you are already in Panama. That was a fast trip from Chile. Were you fleeing from the Volcano? smilies/cheesy.gif

It is not too hot here yet. Mercifully, the Rain Gods have decided to give us a break.

BTW, did you hear that the Indian Navy managed to capture 23 Somali Pirates in the Gulf of Aden? Talking of it, hope our friend "The Guest" is safe and sound!

Thanks. BUT...BUT...., you said Fatima was going to join ya on your boat for X-Mas and New Year. What changed your mind? I am not too fond of the Northeast.

The Indians seem to be in favor of handing the pirates over to the U.N. Too gentlemanly, in spite of Bombay being attacked , IMHO. I wonder why their Navy has taken a tougher stance against the pirates.

Anyway, good to know that you are safe and sound in "Mid America" harvesting pearls. You keep in touch.

  • Ahmadinejad's Visit: Iran, Honduras and Brazil's Hypocrisy in Dealing With Them

Ahmadinejad and Lula The Brazilian diplo-MÁ-cia (bad diplomacy) carries on its accelerated course towards the non-acknowledgment of human rights, although sometimes it takes pleasure in saying that it does precisely the opposite. The visit of Iran's president, Mahmoud Ahmadinejad, is another example of a diplomatic omission that verges on hypocrisy.

Child labor in Brazil One hundred and eleven years after Brazil abolished slavery, the number of workers deprived of their freedom is still huge. • Some Humility Would Do Lula Good. On Human Rights Brazil Has Long Way to Go

A prison in Rio de Janeiro, Brazil On November 7, 2009 a few friends and I had an opportunity to take a look inside a Brazilian jail outside the city of Rio de Janeiro. We were able to take some amateur footage of our experience on video (see link below). It's no surprise, of course, that the typical Brazilian jail lacks some of the functionality of those in North America or Europe, but our experience that day was quite shocking.
