Brazilian Couple Convicted for Homeschooling Their Two Kids PDF Print E-mail

Brothers Jonatas and Davi were homeschooled Cleber and Bernadeth Nunes from Timóteo, a city 196 km (122 miles) from Belo Horizonte, the capital of Minas Gerais state, have been convicted by a second civil court in Brazil for homeschooling their children, despite passing government-imposed tests that teachers admitted they could not pass themselves.

The three judge panel in the court of second instance refused even to examine the test results, which give a passing grade to both of their sons, Jonatas and Davi de Andrade Nunes Amorim, 14 and 15, for a series of highly rigorous tests on a variety of subjects, including mathematics, geography, science, history, Portuguese, English, arts, and physical education.

"We cannot even allow the examination here of the quality of education that is being given at home, because homeschooling never can be substituted for regular instruction," said Judge Almeida Diniz, a member of the panel.  The tests were ordered by a criminal judge who is trying the same case in his own court.

The civil court also refused to receive into evidence an assessment showing that the children are psychologically healthy, have a good relationship with their parents, and have friendships outside the home.  Both tests were ordered by a criminal court that is also trying  the Nunes' case.

Despite national assessments showing abysmal results from the Brazilian public education system, one of the three judges claimed in his written verdict that "the quality of our education is undeniable.  If we compare ourselves, for example, average Brazilian citizens with average North American citizens, the conclusion is devastating.  North Americans know little...in comparison to Brazilians.  Our schooling is, to the contrary, very good in comparison to other countries."

João Senna dos Reis, an opinion columnist with the Diário do Aço newspaper, mocked the statement, noting that "a simple official verification that 70% of Brazilians don't know how to read and interpret five lines of banal text represents a shocking confession of how our education system is going."

"At some point the magistrates had to act in bad conscience before invoking absurdities like selling the false image that we have an education system at the level of First World countries," he added. "As we are in December and every kind of list of notable events begins to appear, it won't be a surprise if this court is listed in the category of the best joke of the year."

Cleber Nunes told LifeSiteNews that he intends to appeal the case to the Superior Tribunal of Justice, a federal appeals court, and if necessary he will appeal the case to the Supreme Federal Tribunal, the nation's highest court.

"I don't think the court even wanted to examine the case, just because they don't want more families to do the same (homeschool their children)," Nunes said.

"It was clear that the kids are doing well, that there is no intellectual abandonment, but they keep defending their position, defending the law and forgetting that the focus of the law is the children," he said.

kinda looks like when it was ileagle to teach blacks to read or do math .
JUST TRYING TO DO A GOOD JOB FOR THERE KIDS .
when most parents in brasil dont care about school for there kids

goes to show that the system is very off if the teachers can not pass the test requried
and 2 parents do a better job than state employes .

of course the private sector is always better than civil servants.

and the courts of injustice going along with them

WE AS PEOPLE SHOULD BUILD THEM A SCHOOL SO THEY CAN HAVE A SCHOOL TO TEACH OTHERS

but how could brazilians teachers be legal teachers when THEY ADMIT they are unable to pass the government
students tests ?????

At least a formal proof of how NON knowelgable your Legal & Government Approved teachers are.
Or said otherwise......how good is your education system in view of your teachers unable to pass governments tests...on subjects they were supposed to teach to the students ?

And of course in Brazil, the unofficial teachers, who can teach very well to the students who can finally pass these governments tests are found....ILLEGAL AND NON ACCEPTABLE...OF COURSE !!!!
These good teachers should be punished, fined and avoided of course........instead of looking why their students can pass governments tests that are unable to be passed by the Legal teachers !!!!!

The fact that Judge "head up his ass" compares Brazil to the northern continent of the Americas is telling in of itself. I won't defend the the United States' record on education; for such a wealthy country (well, we'll see in a couple of months) it is appalling that there are so many knuckle dragging single synaptic morons who actually revel in and embrace their own stupidity. Thank Thor, that Bush's 8 year war against intelligence is over. Still, I think if a learned JUDGE can't distinguish between a continent and a country, then he shouldn't be presiding over any issue (you Brazilians really need to get over calling the US North America mkkkk), let alone issues pertaining to education. Canada btw, one of the THREE North American Nations, pounds both the US and Brazil in PISA educational rankings for both reading and math. Oh Snap!

Those who got a bad rating in their scholarship tests !

and it is rather funny to read "North Americans know little...in comparison to Brazilians"

What is for sure is North Americans know how to produce cars, drugs, mainframe computers, trucks, tractors, harvesters, airplanes, PCs, softwares.
And also toothpastes, soaps, hamburgers, coca cola that they can produce the world over and sell to the world over.

What about Brazil on the above items ??????????

But also true that the USA are the world best to export TOXIC DEBTS, such as U.S. subprimes, Lehman and Bear Stearns structured notes, GAAP accounting such as Enron, Worldcom etc and recently...MADOFF accounting ! smiles.
Because what means GAAP ?
GENERALLY ACCEPTED Accounting Practices ! Right ?
Welll MADOFF has proven that HIS accounting was under the GAAP laws for well over a decade !!!!!!
Even AUDITED BY THE SEC....."FORTUNATELY" who found....NO PROBLEM....UNDER GAAP & SEC laws.

In my view they should call it GAPING accounting practices !!!!
Same by the way for the "respectable" U.S.rating agencies. TOXIC DEBTS ? No problem, rated AAA, so that they can be issued and sold ! Brazil foreign debts ? No problem, rated investment grade....but at BBB, much lower than TOXIC DEBTS !!!! Hmmmm !

Did all these debts owned by banks needed Minimum Capital Requirements collateral to be put at the FED...as per BIS rules ?
No problem, to avoid these requirements, lets transfer these TRILLIONS OF DEBTS to.....OFF BALANCE SHEET....into
OFFSHORE companies. Blessed by GAAP, SEC and IRS...of course !
Such a great idea under the IRS laws ! During the bull market of these debts, profits WERE NOT TAXED, as they were OFF balance sheets. Right ?
Wellll...when these debts incurred losses....still no problem....for the IRS ! Just rapatriate the debts INTO balance sheets.
So that now....... losses can have TAX CREDITS !!!!! Right or Not ??????

All the above were as stated, done in accordance with the U.S. GAAP or Gaping laws ! Also Blessed by the IRS and SEC rules & laws ...of course !

Wellll Welll....that is the USA !

BRAZIL ? No problem either.They discovered that trading FOREX is more rewarding than producing goods such as for the NEW BRAZILIANS FINANCIAL FIRMS as Sadia, Aracruz, Votorantim and the many others that will surface by next January or February when they will announce their fourth quarter and full year results !!!!

Of course, Brazil criticizes the U.S, banks ! But funnily they dont explain why there is SUDDENLY so many Brazilians Banks Mergers
& acquisitions...."SUGGESTED AND BLESSED" by the Government-
Even more funny when these banks mergers and acquisitions are mostly between States and/or Government.... controlled or owned !!!! Hmmm....a lot is obviously HIDDEN !!!!!


CONCLUSION :
- Between the U.S.A. and Brazil....no doubt for me that the USA remains the best....EMERGING nation !
- For the 200 World Best Universities, the USA have a trucload in these 200, Brazil ONE, ranked 196th.
- Midget Switzerland with a population of 7,8 millions, have SEVEN !

Probably this judge found his degree in a detergent pack while buying his groceries in Sorbonne.Never mind. "Gringo"´s comments are very interesting, but modest. The Canucks have managed to produce many good engineers,doctors, etc; in their Universities in spite of their inhospitable land. They do run their country well. Still....what does Canada produce in reality outside of grains, gold and silver, timber and oilsands ?????

May be they are good in readings and writing tests and why not in maths ! So what ?

Sorry but they are a little bit (even more than that in reality) like Brazil....A BOOM AND BUST ECONOMY....DEPENDING MOSTLY
ON BASIC COMMODITIES PRICES !!!!!

Do they have large drugmakers ? Canadian carmakers ? Canadian computers makers ? Software producers ? Precision Machineries makers ? Large food producers ?
For around 20 years they were a sleeping country just like Brazil..since there was no commodities booms until 2003. And now they are going to return to a deep sleep for a long time...just like Brazil !

But.....but...but....at least Canada will continue to have good engineers, infrastrucfures, doctors, universities and hospitals.....contrary to Brazil !!!!

but it's kind of funny to listen to someone from switzerland complain about a lack of regulation and corruption. Afterall, where do the world's criminals open bank accounts? Does anyone doubt that the likes of Al-Quaeda, and possibly Bin Laden himself, had/have swiss bank accounts?

Don't get me wrong, you're spot-on about the toxic debts in the U.S. Was a complete and utter lack of oversight. Although you were incorrect in a couple of your statements. One, the U.S. didn't "export" these debts, greedy european banks and investment firms jumped all over them when seeing the profit margins. Where you are right is that there was little to no oversight and after the REAL AAA investments ran out they continued to bundle these sub-prime mortgages and rate them AAA and in reality they were actually far from it. U.S. banks and mortgage companies were actually giving 30 year mortgages for hundreds of thousands of dollars to ILLEGAL ALIENS! The other part were you are incorrect is about the SEC investigating Madoff.....they never did. That is now the question....why didn't they as they should have been more than aware that something wasn't right long ago. Beleive me, watch and see, it may not happen soon, but it will happen. The american people finally woke up and smelled the coffee concerning illegal immigrants and we're starting to take action. They finally woke up and had enough of the Bush administration and took radical action by electing Obama. One day they'll wake up and realize that not only their financial system, but the worlds, is being controlled by some "New Yorkers" that have origins in the middle east and are responsible for at least half of the problems that we encounter.

Switzerland has had no choice but to clean up it's act, or attempt to, in regulating their banks. Afterall, if they continued to refuse it wouldn't take much more than a couple hours for a 30 man SEAL team and 2 blackhawks to have every swiss in the country trembling behind their hot chocolate while giving us a little....."Yodle-Le-He-Hooooo!!"smilies/grin.gif

Canada makes the best busses in the world. The Prevost is made in Quebec. The MCI is made in Canada and the flatbedded across the border south into North Dakota for completion to meet the "percentage rule" and qualify as made mainly in the USA. Greyhound is almost exclusively MCI. General Motors was the bus of choice for years, made in Pontiac, MI, until unfair practices caught up with them and the congress found them guilty of running a monopoly in the fifties, too late to save Beck, Flxible, and other small makers.

North American long haul busses are of monoque, or integral, construction, and last longer than those with separate chassis, like the busses here in Brazil, except for Mercedes busses built here in the 1970s.

German Neoplans used to be built in Lamar, CO, and German Eagles in Texas, but not any more. I don't want to get into the Eagle-Flxible-Dina story from Mexico. When I say North America in this context I mean Canada and the USA. Canada has also made several airplanes that were exclusively Canadian.

Parents who homeschooled their kids were incarcerated in Vermont, in Iowa, and I remember a case in Nebraska in the 1970s, the Silevans, never met them, were taken to jail and their kids taken from them by Social Services.

John Dewey and the teachers' union. Nothing sends a chill up the spine of a public school teacher like talk about charter schools, private schools, and religious schools. But nothing sends a chill up the spine of all of them, public, private, etc., like talk about home schooling. For some it's money, for some, ideology, and for some, power. Or maybe in the case of unionized public school people, the terror of being found out, in many cases, to be frauds.

Here in Brazil, the UF is either on strike, or there's no electricity, or the students are out blocking the highway protesting something. No maintenance is ever done until all equipment is junk or missing entirely, the bathrooms are all broken, the place looks and smells foul, then the leadership complains until the politicians give them a fortune for a total remodelling and new equipment and vehicles. You would not believe the stuff I have bought cheap at auctions, thru the years, from schools, Embrapa, and various repartições.
