Brazil Minister Proposes Legalization of Marijuana PDF Print E-mail

Marijuana in Brazil Brazil's Environment Minister Carlos Minc called on the country's Supreme Court to imitate Argentina and decriminalize possession of drugs by adults for personal consumption.

"We beat Argentina 3 to 1 in the World Cup qualifiers but in other issues we are loosing and bad. In Argentina judges decriminalized the use of marijuana", said Mind during a Sunday visit to the ecologic park Chapada dos Veadeiros in the central state of Goiás.

"This is a match we are losing with the Argentines," insisted the minister during an open day at the park which included musical shows.

Last August 25th the Argentine Supreme Court declared unconstitutional criminalizing adults in possession of a minimum quantity of marijuana for personal use and with no risk for third parties, thus giving preference to the right to privacy.

The Supreme Court ruling also called on the political establishment to agree on a state policy on drugs to combat the illicit trafficking of narcotics and adopt preventive health and educational measures.

The ruling however did not decriminalize the traffic or trading of drugs and the suppliers involved in the lead case of the five youngsters caught with marijuana - and later released - have been jailed.

The message from the Argentine court is quite clear: having drugs in small quantities, with no ostentations or risk for third parties, is a case of individual privacy, a personal issue and therefore not punishable.

Mexico also passed similar legislation last month and there's a strong move along the Latinamerican continent to change the emphasis on the drugs war.

Several former Latinamerican presidents (conservatives and liberals) have spoken openly in favor of a certain degree of consumption legalization and the decisions in Argentina and Mexico point in that direction.

Brazil could be the next country to join the club, and Minc's comments could be interpreted as trial balloons.

Decriminalization is a move in the right direction, but only full legalization will solve the problem.

Debaters debate the two wars as if Nixon’s civil war on Woodstock Nation didn’t yet run amok. One need not travel to China to find indigenous cultures lacking human rights or to Cuba for political prisoners. America leads the world in percentile behind bars, thanks to ongoing persecution of hippies, radicals, and non-whites under banner of the war on drugs. If we’re all about spreading liberty abroad, then why mix the message at home? Peace on the home front would enhance global credibility.

The drug czar’s Rx for prison fodder costs dearly, as lives are flushed down expensive tubes. There’s trouble on the border. My shaman’s second opinion is that psychoactive plants are God’s gift. God didn’t screw up. Canadian Marc Emery sold seeds that enable American farmers to outcompete cartels with superior domestic herb. He is being extradited to prison, for doing what government wishes it could do, reduce demand for Mexican.

The constitutionality of the CSA (Controlled Substances Act of 1970) derives from an interstate commerce clause. Only by this authority does it reincarnate Al Capone, endanger homeland security, and throw good money after bad. Official policy is to eradicate, not tax, the number-one cash crop in the land. America rejected prohibition, but it’s back. Apparently, SWAT teams don’t need no stinking amendment. Father, forgive those who make it their business to know not what they do.

Nixon promised that the Schafer Commission would support the criminalization of his enemies, but it didn’t. No matter, the witch-hunt was on. No amendments can assure due process under an anti-science law without due process itself. Psychology hailed the breakthrough potential of LSD, until the CSA halted all research and pronounced that marijuana has no medical use, period.

The RFRA (Religious Freedom Restoration Act of 1993) allows Native American Church members to eat peyote, which functions like LSD. Americans shouldn’t need a specific church membership to obtain their birthright freedom of religion. Denial of entheogen sacrament to any American, for mediation of communion with his or her maker, precludes free exercise of religious liberty.

Freedom of speech presupposes freedom of thought. The Constitution doesn’t enumerate any governmental power to embargo diverse states of mind. How and when did government usurp this power to coerce conformity? The Mayflower sailed to escape coerced conformity. Legislators who would limit cognitive liberty lack jurisdiction.

Common-law must hold that adults are the legal owners of their own bodies. The Founding Fathers decreed that the right to the pursuit of happiness is inalienable. Socrates said to know your self. Mortal lawmakers should not presume to thwart the intelligent design that molecular keys unlock spiritual doors. Persons who appreciate their own free choice of path in life should tolerate seekers’ self-exploration.

absolutly great idea, the war on drugs is failing

the truth is, if the world doesnt start to face the reality of drugs and the human desire to consume drugs , it deserves to wallow in its problems, because there are solutions to a range of problems if they would start to legalise marijuana

first, the enormous cost of incarcerating huge numbers of marijuana smokers is crippling society.in these times of financial chaos , it boggles the mind that we spend huge amounts of money for jailing someone everyday for marijuana poesecian. in the usa under bush, the amount of arrests for marijuana are staggering. its unbeleivibe so much waste of time and effort was put forth to just bust marijuana users...

second, in these horrible times of financial crisis, the legalisation of marijuana would be a sure fire jump start of anyones economy. the amount of money generated by this undergound economy is just unbeleivable.it could totaly put huge amounts of tax money into any countries economy...

marijuana is harmless compared to alcohol and cigarettes, its just plain hypocracy to keep it illeagal...do any fair research and you will see that marijuana is much less dangerous than these legal drugs

the other drugs like coke need to be addressed too. where coke really has some dangerous properties, it should be taken out of the legal jurisdiction and put into the social health jurisdiction. people should have to see a doctor and get a prescription. at least it could be regulated, you would know who is doing it and give them direct counciling...something to that effect...

again the amount of money involved in the colcaine underground is unbeleivible and just causes a tremendous sub society to exist and profit and drain society with the drug war budgets and incarcerations.some of the main problems of brazilian cities is directly related to illeagal trafficaing of drugs

people should be sent to jail for violent crimes or asaults or stealing etc not for drugs

if brazil really wants to show independance from american influence, this would be a wonderful way to demonstrate brazil thinks for itself...i dont think it will ,however, too much influence by the catholic church

the 1937 marijuna tax act brought up by anslinger is one of the most bs peices of legislation on the books...look up the real history of it

unfotunatly , the world is full of uptight people with no vision of the future , no idea how to really confront the problems facing them and no idea how to come up with creative solutions

as long as the world wants to play games with antiquated arcaic drug laws and create huge crowded jails systems filled with people who only deal with drugs less harmful than alcohol and cigarrettes, and not take advantage of huge tax revenues they all could desperatly use now, then the world deserves to keep wallowing in its own excrement of phony problems...

there is overwelming evidence that there are incredible medicle properties in canibis

if you do some fair and extensive research, its mind blowing what good properties canibus has....

beside incredible health properties that would make you put it on a special list of medicle help that people need to get through everyday life,like back pain, migraines, cancer recovery, and much more, the oil from marijuana seed can be used for alternative fuels...the plant is one incredible thing...yet the anslinger marijuana tax act has set us back many steps.

my god we need all the incredible recources on the planet now that can really make a differance in this unbeleivible world financial disastor that is cripling everyone

However, you may note that cannabis is also caught up in the politics between hemp and cotton...and who would buy cigarettes when they could smoke cannabis?

Forget proven medical advantages of cannabis and pharmaceutical industry lobbying against legalization.
Forget proven commercial advantages of hemp and the cotton industry lobbying against legalization.
Forget proven political support for commercial prisons, who profit by maximum capacity, lobbying against legalization.

Remember that the politicians are promising freedom and delivering debts, destruction, and death. You see, they never forget who gave the money!

US Supreme Court obviously does not subscribe to the above statement. The simple truth has certainly made itself clear by the state of health in the US. The 'pharmaceutical industry' has monopolized the use of "anything" other then what it determines is considered a medicinal. This "power" being given to them by the authority of the government. Therefore, they have recently negotiated with the US government for a non-negotiable $1 Trillion contract for 10 years. Does it appear strange that Obama campaigned against this massive expenditure and then reversed to try to get them to agree on health care? Even the 'agent of change' must suscribe to the 'status quo'. Note the warning of many recent drug promotions. Side affects, including death readily acceptable as a course of drug treatment. Let the buyer beware!

IMHO....Everything produced by nature is a gift from God to mankind. What mankind does with these gifts has sustained humanity for thousands of years. Note that each civilization has been given those plants, animals, and other gifts that they needed for basic survival. This is not accidental nor is it coincidental to the basic survival of each geographic or demographic culture.

* Marijuana - a naturally growing plant is God-given. Any properties or effects of this natural organic plant cannot be labeled as illegal. Given by God (unless someone can prove otherwise) consumption of this product "in its natural state" cannot be ruled illegal for personal consumption or cultivation.
* Coca - a naturally growing plant is God-given. Any properties or effects of this natural organic plant cannot be labeled as illegal. Given by God (unless someone can prove otherwise) consumption of this product "in its natural state" cannot be ruled illegal for personal consumption or cultivation.
* Opium - a naturally growing plant is God-given. Any properties or effects of this natural organic plant cannot be labeled as illegal. Understand this very important caveat to my words, "in its natural state", because it is the boundary where things are altered by artificial means to produce both positive and negative results depending on the additives. I know what many will say; "what of the case for hashish or hash oil?", "what of coca paste?", "what of black tar opium?". In this manner the indigenous populations of the world do not have their God-given gifts declared illegal by some foreign cultural differences. "How dare any foreign power declare another nations historical and cultural resources illegal!" Under the pretext of a "war on drugs" nations are thrown into chaos, violence creates more violence, crops are destroyed, farmers are sickened, and cannot provide for their families. Such is the case of coca and the Andean peoples everywhere. Are we to believe these people are subject to the death penalty in the exercise of their God-given rights to their inheritance? The issue is simply one of regulation. Once the product is sold at market it becomes the governments responsibility to tax, regulate, and inform on the product. Commercial applications being taxed at one rate and consumer applications taxed at a reduced rate. The key being that the product is taxed and regulated consistent with the normal course of trade. This makes it more difficult to divert large quantities to illegal enterprises. It may be that farmers will get more or become threatened to sell their product underground. This has always been a issue for any prized commodity in the world. Is there not all manner of products that are sold or traded under the radar of the taxing authority? This is manageable and should not be the basis for violent conflict or the criminalization of farmers and consumers.

Thanks Dr.Cata. I do appreciate the time and effort you took to write these comments. If our distinguished fellow bloggers take a few moments to reflect on what you say, they would come to a conclusion that you are not really involving them in a "Conspiracy Theory".

What impressed me is your emphasis on "War on Drugs"!. I am not a consumer of Cannabis and I don't feel the need for it. BUT...BUT..., I use the "Poppy seeds" (sold legitimately, in the grocery stores here as well in the U.S. of A, Canada, India, Pakistan, Australia, NZ, etcsmilies/wink.gif, in my FOOD. Good for digestion, like Mustard . As you said rightly, all the natural plants have their nutritious value . They turn deadly, when the chemicals are used to convert into "Popular End Products".

Now, the U.S is in Afghanistan to eradicate the Poppy plants, which are cash crop for them and it is good for health. What alternate food item, the U.S has to offer to the Afghans, Big Mac?

The whole "War on Terror" or "War on Drugs" are quite ludicrous, as you will readily agree with me.

Thank you for the nice essay and look forward to hearing the comments of our other fellow bloggers .EXCEPT that ET (Of course, that guy is fully capable of demanding his "Freedom of Speech" in an alien planet. Legalize marijuana, why not we have other legal addictive drugs.
Nicotine, Alcohol comes to mind. But wait those industries have lobbyists and money.
The hippies have not access to the Washington Money Tsars.
Government has not looked at the tax revenue its loosing to the Cartels.

Or haven’t figured a way to channel that cash into Congressional pockets.

More than 200 tax inspectors have searched Argentina's biggest newspaper, which is currently embroiled in a fierce battle with the government.

Officials said the raid on the daily Clarin was "routine", but the newspaper accused the government of harassment.

President Cristina Fernandez is trying to push through media reforms which she says will modernise the industry.

But critics say the president's aim is to weaken the Clarin Group, Argentina's dominant media company.

President Fernandez and her husband, former president Nestor Kirchner, have in the past accused Clarin of biased reporting and described the group as a "monopoly".

Thursday's raid came on the same day Clarin newspaper published a report alleging a government farm trade controls agency granted a 10m peso ($2.6m, £1.6m) subsidy to an agricultural firm without authorisation, local media report.

THE CORRUPTED politicians in the vote buying scandal, proven guilty by the investigators, have been pardoned by the other senators just as corrupted as the ones they pardoned...but in a secret vote so that no one knows who pardoned...OF COURSE !!!!
Same for Sarney who still has Robbing Hook support.
Same for Sarney Bunker...where no doubt minors WORKED...if you see what I mean !

As someone above said something like....WE SHOULD BE FREE TO DO WHAT WE ALL WANT !
But brazilians do so.....already...for decades !
Even your polices forces do so. They exterminate drugs gangs.,...so that they polices forces can control the drugs markets !

And who stops them ? NO ONE ! And certainly not the Brazilian INjustice...themselves corrupted to the roots !

What a world....what a Decadent World !
Dont worry....not only in Brazil...but Brazil is certainly NOT a good example to follow !

not that i would ever in my life ever need to try it, even if the big studs in rio are using it to keep up with thier image ( i read this as a fact), even though its as easy to walk in any pharmacie and buy it like aspiran , even though the bike champions and other athletes are using it to deal with altitude, even if the doctors are prescribing 3 aday for my sick mother, even though it is better than coke and lasts longer, really giving you a blood rush through your head and body...i mean why would i ever want to do what the rio studs know they have to do ? why would i ever decide to maybe pop a viagra and have the pau duro for as long as i like and do it 3 times in a day or more if i want...?

why in the god damn hell would i ever think of doing it ?

Valid medicinal value, it’s a victimless crime, the War on Drugs WAY too costly, too many arrests for simple possession, tax it and use the money to pay for health insurance and to reduce the deficit…Woodstock Universe supports legalization of Marijuana for a variety of reasons.
