Brazilian President Wants to Jail Journalists Who Use Wiretaps PDF Print E-mail

Veja magazine cover The IAPA (Inter American Press Association) is voicing concern at a bill introduced to congress by Brazil's executive branch that would amend the rules regulating wiretaps and make it an offense punishable with imprisonment for journalists and news media executives to divulge information obtained from wiretaps without a judge's authorization.

The chairman of the IAPA's Committee on Freedom of the Press and Information, Gonzalo Marroquín, offered support for the arguments made by Brazil's National Association of Newspapers (ANJ) criticizing the bill introduced by President Luiz Inácio Lula da Silva's government.

The new law would set ground rules for unlawful wiretaps, a move that the organization said "directly affects freedom of the press and amounts to nothing less than an authoritarian and undemocratic proposal."

Marroquín, editor of the Guatemala City, Guatemala, newspaper Prensa Libre, explained, "This amendment, apart from penalizing the unlawful conduct of government officials engaged in telephone wiretapping, at the same time unfairly places the blame on journalists for divulging information that may have been leaked to them and which could be of public interest. In consequence, what is really jeopardized is the people's right to be informed."

The proposed law, currently under debate in the Chamber of Deputies (lower house of Congress), would make it a criminal offense for individual journalists, the press and their news sources to divulge either lawful or unlawful phone taps without court authorization.

The project amends Article 15 of the Penal Code, increasing the prison term from three to five years and imposing fines on anyone who "directly or through third parties" carries out telephone wiretapping "for purposes other than those foreseen under the law."

Penalties are increased 50% when a public official is involved. Final passage of the bill would amend Law 9,296/06 which regulates electronic surveillance.

The issue of clandestine recording of phone conversations originated with complaints about wiretaps on politicians and members of the Federal Supreme Court. The most recent incident was the recording of a phone conversation on July 15 between Supreme Court Chief Justice Gilmar Mendes and opposition Senator Demóstenes Torres, published in the magazine Veja a month later.

The magazine said the information had been provided by an anonymous source belonging to the Brazilian Intelligence Agency (ABIN), an agency of the Executive branch.

Just who might have ordered the wiretap has sparked an internal debate within the federal government involving official departments, cabinet ministers and members of the judicial and legislative branches. In October 2007, Brazil's Chamber of Deputies set up a Parliamentary Investigative Commission to look into the issue.

My friends and in-laws in Rio de Janeiro call me Carioca because of my love for the people and gorgeous country of Brazil. I've been there countless times and plan to live there in the near future.
I must admit, I do get a kick out of your nonsensical imperious attitude. My father-in-law grew up dirt poor and managed to become one of the most prominent orthodontists in the state of Rio de Janeiro. I admire a person like that so much more than someone who grew up with a silver spoon up his you know what ( as presumptuous as that sounds, I bet I'm right about you ).

The gist of what I wrote had to do with the socialistic band aid that is being forced down the throats of we, the American taxpayer. The reason being fed to us by the crooks who got us there in the first place was to SAVE the GLOBAL financial system....including Japan's. Is Japan weak or bad these days? Have you taken a look at the chart of the Nikkei? After their lost decade, they deserve a break.
I'm well aware of the public debt to GDP ratio in various countries, and, the over 100% external debt to GDP ratio in the U.S. (as opposed to 30% in Japan) which doesn't make me happy either. High savings rate in Japan, negative rate here in the U.S.
And by the way, what's this fixation with junkieism? Sounds like the constant pablum that you spew is quilt for all those years your probably spent in Needle Park in the 90's.

If you would attempt to free yourself from that prison your languishing in called your perspective, you could go back to the article you are referring to. U.S GDP is 13.8 TRILLION dollars. U.S. External debts are 12.5 TRILLION dollars. Your right CH.C, it only comes out to about 93% of GDP. I'll take your advice and discard the Swiss calculator I initially used in favor of the $5 Chinese solar one. In case you are interested, GDP of Japan is 4.29 TRILLION dollars. Japanese external debt is 1.49 TRILLION dollars. According to my new calculator, that comes out to about 35% of GDP.

I didn't know that this was such an issue. I don't believe that wiretaps should be used at all. This is a major invasion of privacy in the first place. I don't think the public, Press included should have the ability to have wiretaps. In most instances I don't believe that the government should have the ability to have wiretaps.

if maybe at least parts of the Brazilian population are very efficient indeed. Rather than work for one miserly salaria (or less), they choose not to work at all. That's efficient! Divide output by input (i.e. zero work at all) and the efficiency goes off the charts. Bravo to those that can lead such wonderful lives.
