Brazil's Police Rule US Pilots Caused Country's Worst Air Tragedy

Gol's Boeing 737 fallen in the Amazon, Brazil Brazil's federal police has finished its investigation on the causes of the worst Brazilian air accident ever, which killed 154 people, after a Boeing collided with an executive Legacy jet piloted by two American, last September.

Roberto Sayão, the police chief in charge of the case is writing his final report, but his conclusion is already known. Sayão has determined that the two American pilots should be blamed for the tragedy.

This information has already been passed to a congressman who is member of a congressional commitee investigating the chaotic situation of the Brazilian air space and the turmoil among air controllers, who for the most part are military men.

The investigative committee has decided to hear at least 13 witnesses, among them police chief Sayão.

The revelation about Sayão's conclusion has appeared in a blog maintained by Josias de Souza, a reporter from daily Folha de S. Paulo. The Federal Police inquiry, the journalist reveals, indicate that the two pilots were negligent.

The federal police chief has already decided to recommend to the Public Prosecutor's Office that it file a lawsuit against Joseph Lepore, 42, and Jan Paladino, 34.

According to the federal police inquiry, the American pilots not only disrepected the flight plan putting their small jet in a collision course with the Boeing, but also were negligent for only turning on the transponder - the anti-collision equipment - minutes after the collision between the two planes.

Weren't the Brazilian air controllers also negligent? This is not for me to say, responds Sayão. They are military men and he cannot probe their actions as he was told in no uncertain terms by the military brass. This is the job of the Air Force, he argues.

That's laughable. Par for the course although. Don't educated brazilians get tired of these national dispalays of ignorant prideful indignation?

So it's left up to the military to decide if the military has fault. Must be nice to always be the fox in the hen house.

So, the pilots may have some fault but not being able to investigate the wrong commands given by the ATC personnel is beyond incredible. Basically, justice will never be fully served and everything will end up in a pizza party....

Let's see ... the Brazilian air traffic controllers VERBALLY INSTRUCTED the passenger jet pilots AND the Legacy pilots to fly at the altitude at which the collision occurred ... the Legacy pilots followed those instructions as did the pilots of the passenger jet... but SOMEHOW it's NOT the fault of the Brazilian air traffic controllers who gave those instructions??? Does Brazil EVER take responsibility for it's woes, it's cultural, social and economic problems, or is EVERYTHING bad that happens in Brazil ALWAYS someone else's fault??? Just as in the U.S., the military investigating the military is an exercise in futility.

Don't be intimidated Brazilians!!! All other articles don't mention the "don't touch because they are under the military jurisdiction" The judiciary is the one in power and it has the authority to subpoena any military employee such as the ATC.

Is this the same judiciary that here in the past few weeks in Rio has been caught, on tape asking and taking bribes for lottery operations and illegal syndicates? What can we expect but injustice. I fly alot and I am always a bit nervous flying over the amazon...thinking the real reasons for the Gol flight going down may never be made public..

Dont get nervous. I have flown over the Amazon several times too. Dont think about the real reasons for the Gol flight 1907 going down until the investigations are completed.Just relax and think nothing is going to happen to you,while you take a flight.Have safe trips.

America and the world should stop servicing Brazil. We Fly in via Chile (Lan Chile). That way we miss the amazon's Black Holes.
It's amazing I have known about the problem for years. It only took over one hundred deaths for the majority of the World to see the problem. I know of NOTHING that will Fix it...THAT THE WAY IN BRAZIL!!!!

and was uncovered by the Brazilian media wasn’t it? Is your conclusion than that the entire judiciary system is corrupted? You couldn’t name one single senator of the judiciary committee... much less to know their judiciary history …But lets go to the point there are a few major points that nobody is talking about here in this site:
a) Lets not loose site of the fact that it was a federal investigation that brought this case to light. See insert -A
b) That Gtech, the West Greenwich, R.I. American Company was charged for lottery fraud before, this time in Houston Texas and the investigations were mysteriously gone away …??? See insert-B

Apart from the Gtech executives, federal prosecutors in Brazil accused seven other people of committing illegal acts and using their positions in the government to facilitate the renewal of the lucrative contract.
Gtech, based in West Greenwich, R.I., denies any wrongdoing. In a statement, the company said it has encouraged Antonio Carlos Rocha, Gtech's former president in Brazil, and Marcelo Rovai, the local marketing director, to "cooperate fully" with investigators. Brazil is Gtech's largest overseas market.
"Gtech is confident that their actions were appropriate and the company was simply the target of an extortion attempt that was promptly rejected," read the statement, signed by Robert Vincent, a Gtech spokesman.

first Executive Director of the Texas Lottery resigned, she was
replaced by Lawrence Littwin who did not keep the job for long.
Mr. Littwin began investigating G-Tech's "political contributions"
and was terminated rather suddenly - but - G-Tech paid
Mr. Littwin a reported $300,000.

During a press conference held after he was terminated, he
warned Texans that they were being cheated by the Texas Lottery.
This was reported in the major Texas newspapers.

Folks, he was right - we have been cheated by the Texas Lottery
and our elected officials have done absolutely NOTHING about it.
I still want to know WHY.
